NLRC NCR SEnA Desk Facilitates P62K Settlement for Delivery Rider
Quezon City – The National Labor Relations Commission (NLRC) National Capital Region (NCR) Single Entry Approach (SENA) Desk has successfully facilitated a settlement amounting to P62,379.79 for a delivery rider. Assisted by SENA Conciliator-Mediator Josephine A. Gallenero, the settlement addressed an employment dispute and demonstrated the effectiveness of the SENA program in resolving labor issues.
The delivery rider, who sought resolution for unpaid 13th month pay and benefits under the service incentive ownership agreement (motorcycle ownership), reached an amicable agreement with his employer, a manpower solutions provider, following a series of mediation sessions.
It is a settled rule that delivery riders are considered regular employees if their tasks are essential to the core operations of the company. As regular workers, they are entitled to security of tenure and labor standards benefits. The Supreme Court applied the four-fold test and economic reality test in determining employer-employee relationship between the delivery rider and the company.
